1. Service Description

AIOKA is an AI-powered crypto intelligence platform that provides market analysis and trading signals via a REST API. The service uses 6 specialized AI agents to analyze 27 live market signals and deliver consensus verdicts on cryptocurrency markets, primarily Bitcoin (BTC).

Our Services include:

• AI Council verdicts and confidence scores
• Market regime detection
• Signal aggregation and analysis
• Ghost Trader paper trading signals
• Historical data and backtesting (on applicable tiers)

2. Eligibility

You must be at least 18 years of age to use our Services. By using AIOKA, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Accounts and API Keys

To access certain features, you must register for an API key by providing your name and email address. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your API key
• All activity that occurs under your API key
• Notifying us immediately of any unauthorized use

You may not share, sell, transfer, or sublicense your API key to third parties. We reserve the right to revoke API keys that are used in violation of these Terms.

4. Service Tiers and Pricing

AIOKA offers the following service tiers:

• Free ($0/month) — 10 API calls per day, access to latest verdict, market regime, and free API key generation
• Basic ($49/month) — 1,000 API calls per day, signal breakdown, verdict and regime history, council agent votes
• Pro ($199/month) — 10,000 API calls per day, full AI Council access, Ghost Trader signals, backtest API, priority support

Pricing is subject to change. We will provide at least 30 days' notice before any pricing changes take effect for existing subscribers. You may cancel or change your subscription tier at any time.

5. Acceptable Use

You agree NOT to:

• Use the Services for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble our systems
• Circumvent rate limits or access controls
• Use automated scripts to abuse the API beyond your tier limits
• Redistribute, resell, or sublicense API data without written permission
• Interfere with or disrupt the integrity or performance of the Services
• Attempt to gain unauthorized access to any part of the Services
• Use the Services to manipulate markets or engage in market abuse
• Misrepresent your identity or affiliation when using the Services

6. Not Financial Advice

You acknowledge and agree that:

• All content provided by AIOKA is informational only and should not be construed as financial advice
• Trading cryptocurrencies involves substantial risk of loss and is not suitable for all investors
• Past performance does not guarantee future results
• You should consult a qualified financial advisor before making any investment decisions
• You are solely responsible for your own investment decisions and any resulting gains or losses
• AI-generated verdicts and signals may be inaccurate, delayed, or based on incomplete data
• Market conditions can change rapidly and without warning

7. Ghost Trader Disclaimer

Ghost Trader is AIOKA's automated paper trading system. It demonstrates how our AI signals perform in simulated market conditions.

• Ghost Trader uses an initial simulated capital of $10,000
• Results shown on our website represent paper trading since March 27, 2026
• Simulated results may not account for real-world factors such as slippage, liquidity, exchange fees, or market impact
• You should not rely on Ghost Trader results to make real investment decisions

8. AI-Generated Content

Our Services use artificial intelligence (powered by Anthropic's Claude) to generate market analysis, verdicts, and signals. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or biases
• AI models may produce different results for similar market conditions
• AI analysis should not be the sole basis for any investment decision
• We do not guarantee the accuracy, completeness, or timeliness of AI-generated content
• AI models and algorithms may be updated, changed, or improved at any time

9. Intellectual Property

All content, features, functionality, algorithms, models, designs, trademarks, and intellectual property associated with AIOKA are owned by us and are protected by applicable intellectual property laws.

Your use of our Services does not grant you any ownership rights in our intellectual property. You may use data received through the API for your personal or internal business purposes, but you may not redistribute, resell, or publicly display raw API data without our written permission.

10. Rate Limits and Fair Use

Each service tier includes specific API call limits. We enforce these limits to ensure fair access for all users:

• Free: 10 API calls per day
• Basic: 1,000 API calls per day
• Pro: 10,000 API calls per day

Exceeding your rate limit will result in HTTP 429 (Too Many Requests) responses. Persistent abuse of rate limits may result in temporary or permanent suspension of your API key.

11. Service Availability

We strive to maintain 99.9% uptime for our API services. However, we do not guarantee uninterrupted or error-free service. Downtime may occur due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Unscheduled maintenance to address security vulnerabilities or critical bugs
• Third-party service outages (exchanges, data providers, hosting infrastructure)
• Force majeure events beyond our reasonable control

12. Limitation of Liability

Our total aggregate liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to AIOKA in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless AIOKA and its operators from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any trading or investment decisions you make based on our data

14. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, including but not limited to:

• Violation of these Terms or our Acceptable Use policy
• Abuse of API rate limits or system resources
• Fraudulent, illegal, or harmful activity
• Non-payment of applicable fees (for paid tiers)

You may terminate your account at any time by contacting us at info@aioka.io. Upon termination, your API key will be revoked and your access to the Services will cease.

Sections that by their nature should survive termination will survive, including Limitation of Liability, Indemnification, and Governing Law.

15. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes that materially affect your rights, we will provide at least 30 days' notice via the email address associated with your API key.

Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
